General Terms and Conditions

Thank you for choosing Bayrunner Shuttle (Bayrunner, Inc.), for your transportation needs. We have more than 18 years of hands-on experience in the ground transportation industry and are committed to providing you with a safe, first-class transportation experience. This document sets forth the terms and conditions of the agreement between you (the “customer” or “you”) and BayRunner Shuttle relative to the transportation services that you have requested. By utilizing BayRunner services, you agree that you understand the effect of the terms and conditions and you agree to be bound by the terms and conditions.

TICKETS:
BayRunner Shuttle tickets are limited as endorsed and are non-transferable by passengers or among passengers. The unauthorized resale of tickets is strictly prohibited and will be prosecuted. No reservations are accepted unless expressly stated otherwise. Tickets are valid ONLY for the scheduled date and time for which the ticket has been purchased. BayRunner Shuttle is not responsible for lost or stolen tickets.

FARES and FEES:
Fares are valid ONLY for the scheduled date and time selected. Discount fares are subject to date, time and schedule restrictions. Fares may be subject to additional charges including taxes, fees and carrier price differences. For non-refundable and advance purchase tickets, departure dates and times may be changed as far in advance of the departure date as possible for a fee plus the cost difference of the new ticket if applicable. Passengers may reschedule travel dates with the Peter Pan Bus App or online at www.peterpanbus.com. Tickets not exchanged prior to the schedule departure time(s) are not eligible for re-issue. A new ticket for the newly intended travel date/time will need to be purchased. Fares are subject to change. Peak and holiday travel blackouts may apply. Fares are payable in U.S. dollars only unless stated otherwise. The original ticket will remain non-refundable. The difference in cost of the ticket and our standard reissue fee will apply! CANCELLATIONS AND REFUNDS:
Here at BayRunner we understand that sometimes your plans may change, if you need to cancel we require 24 hours notice. When you cancel 24 hours in advance of your scheduled trip you will receive a credit to use within 18 months, or a refund to your credit card for the fare amount minus a $10 processing fee. Any cancellations within 24 hours of travel are non-refundable.
For passengers booked directly with BayRunner Shuttle (website or phone):
If a passenger misses their shuttle due to a flight or train delay, they can move to the next available shuttle on the same day free of charge.
There will be NO REFUNDS or future credits for anyone who does not wish to wait for the next available shuttle.
If a passenger misses the last shuttle of the night due to a flight or train delay, they may move their reservation to any shuttle on the following day.
BayRunner dispatcher MUST be able to confirm that the flight or train the passenger was scheduled on was in fact delayed or canceled, no changes or credits will be issued to cancellations that cannot be verified.
No refunds will be issued for missed shuttles due to connection delays or cancelations.
Passengers who booked through a third party including but not limited to Greyhound, Flix, or Amtrak must contact the selling agency for refunds or changes.
The fare refunded does not include the refundable fare fee or other ticketing fees. The fare itself is the only portion that will be refunded. Fare refunds will be processed within 5-7 business days to the original method of payment.

IMPORTANT INFORMATION REGARDING TICKETING AND BOARDING:
Passengers must present either their ticket (including the bar code) and/or QR code on an electronic device, or a printed ticket (printed single-sided), and a valid photo ID (matching the customer’s name on the ticket) to the driver/gate representative.

Passengers who purchase tickets in person at a ticket counter will receive a paper ticket to present to the driver when boarding.

SPECIAL FARES:
Special fares are subject to availability. If the quoted fare price is no longer available at the time of final booking, the current price will apply and be displayed as an option.

TRAVEL
Departure dates and times are subject to change. Carrier is not responsible for delays in connections caused by conditions beyond its reasonable control including, but not limited to, breakdowns, equipment failure, accidents, and road, traffic or weather conditions. Carrier shall not be liable for, and expressly disclaims responsibility for, any loss, damage delay, or expense arising as a result of such condition. Accommodations for senior passengers or passengers with a disability, seating is on a first come/first served basis and is without regard to race, color, creed, national origin or any other protected characteristic. Customers are required to be at their departure location at least 15 minutes prior to the scheduled departure time. The bus will leave on time and BayRunner Shuttle is not responsible for late passengers.

BAGGAGE/PERSONAL BELONGINGS:
BayRunner Shuttle is not responsible for lost or stolen items, baggage or belongings. BayRunner Shuttle does not check bags. BayRunner Shuttle is not liable for baggage, the contents of baggage, or personnel belongings. Passengers are expected to keep their personnel belongings, especially valuables such as cell phones, tablets, laptops in their possession at all times while traveling. The carrier is not liable for any lost, stolen or damaged personnel belongings. All baggage must be claimed promptly upon arrival at the destination terminal. BayRunner Shuttle suggests that nothing of value be brought on the bus.
BayRunner Shuttle is not responsible for any items left on the bus after a passenger(s) has disembarked the bus and/or at the destination or conclusion of the trip. Passengers shall be responsible for removing and controlling his/her own personal property and baggage. BayRunner Shuttle shall not be liable for any injuries to a passenger or passengers caused by or resulting from the falling or shifting of baggage while in transit. In no event will BayRunner Shuttle transport personal property, baggage or items unless the owner of the personal property has purchased a ticket and is traveling on the same vehicle as the baggage. BayRunner Shuttle has no responsibility for damage, breakage, deterioration, delay, and/or loss of any prohibited article or any article not specifically defined as acceptable in baggage service or for damage, breakage, deterioration, delay, and/or loss caused by such unauthorized articles to other baggage belonging to the same customer.

Customers traveling outside of BayRunner Shuttle’s service network, connecting to/from other carriers, or if checking baggage for transportation over the lines of other carriers, the ticket issuing carrier does not assume responsibility for the transportation over the lines of other carriers, except as responsibility may be imposed by law or agreements between carriers with respect to baggage.

We can usually accommodate 1-2 bicycles on the shuttle with 24 hours of advance notice. Please call the office at 410-912-6000 to check availability before booking your reservation. There will be a $10 charge for all bicycles. Availability is not guaranteed.

The following items are prohibited from all baggage (both carry-on and baggage stored in the bus baggage compartment):

Acids
Alcoholic beverages or liquor (including beer, ale and wine)
Ammunition
Animals, pets (see note below*)
Articles exceeding baggage size limitations
Backpacks, baggage or other items with attached or protruding articles
Batteries containing liquid acids
Combustible liquids
Corpses or ashes of cremated corpses
Cylinders containing compressed gases
Explosives
Films – flammable
Firearms, all types
Fireworks
Flammable items
Furniture
Gases
Hazardous (dangerous) articles
Live fish, poultry, reptiles
Matches, strike-anywhere
Materials that have a disagreeable odor
Merchandise for resale (except sample baggage)
Phonograph records
Poisons
Radioactive materials
Television sets
Weapons (includes toy and replica weapons)
The following additional items are prohibited from baggage stored in the bus baggage compartments – these items should only be stored in carry-on baggage:

Jewelry
Laptop computers
Money
Passports
Perishable items, including foodstuffs
Prescription medication (doctor prescribed) – must be kept in the possession of the passenger at all times
*Service animals, assisting a passenger with a disability, are permitted on board

LOST AND FOUND POLICY

BayRunner Shuttle is not responsible for personal property of any nature left behind or lost on the coach, in the terminal or in any terminal or on a charter stay. If we are able to find an item left behind, BayRunner Shuttle will ship it at the registered passenger’s expense to the registered passenger upon request. Shipping charges will be charged to the registered passenger once we are given a valid credit card number. Items unclaimed will be held for a maximum of 14 days at which time BayRunner Shuttle reserves the right to dispose of or donate the item(s) to a local charity in the discretion of BayRunners, Inc.

TRAVELING WITH CHILDREN:
Children age 15 and under must be accompanied on the same bus by a parent, legal guardian, or another passenger at least 18 years old. Any traveler, regardless of age, occupying a seat must pay the applicable fare. One child under ten (10) years of age does not require a paid fare to travel but must be listed on the reservation and ride in a seat. If traveling with more than one (1) child under the age of ten (10), a ticket should be purchased for the second child and the child should be secured safely in the seat next to the guardian. All children must follow Maryland laws regarding car seat use.

CUSTOMERS TRAVELING IN WHEELED MOBILITY DEVICES:
Any traveler who intends to travel in a wheeled mobility device is encouraged to book as far in advance as possible. This is important because seating is limited for all passengers, many trips involve multiple carriers and some schedules are reservation only. BayRunner Shuttle may not be able to accommodate all customers traveling in a wheeled mobility device as each bus is limited to one passenger traveling in a wheeled mobility device. PET POLICY:
Pets are welcome on our shuttles with advance reservations.
All pets must remain properly secured within their carriers throughout the journey.
Dogs: Dogs weighing 20 pounds or less will incur an additional $25 fee per way and may ride in the lap of their owner or on an empty seat, subject to the driver’s sole discretion.
Dogs exceeding 20 pounds will be charged as additional passengers and must travel in a crate located in the luggage area of the van or the passenger area of the van subject to the driver’s sole discretion.
Cats: Cats will be accepted only in carriers, with a charge of $25 per cat, per way.
A maximum of two cats are permitted to travel at once.
Standby Basis:
Please be aware that all pet reservations are accommodated on a standby basis. In instances where a van with a luggage trailer is assigned, but a large dog is traveling, the owner and dog may need to wait for the next available shuttle. Refunds will not be issued in such cases.
Allergies: In consideration of passengers with allergies, if someone on board is allergic to a pet, the pet owner will be required to wait for the next available shuttle. No refunds will be provided in this circumstance.

Service Animals: Service animals are permitted on our vehicles and excepted from the BayRunner Shuttle pet policy. However, we kindly ask passengers to consider the vehicle’s size when booking rides with a service animal.
Cats are not excepted service animals as defined by the ADA.
Emotional Support and/or therapy animals are not excepted service animals as defined by the ADA.

LIMITATION OF LIABILITY:
BayRunner Shuttle is responsible only for transportation on its own lines in accordance with applicable tariffs and limitations and assumes no responsibility for any acts or omissions of others, including interline partners, except as imposed by law. In no event shall carrier be liable for consequential or incidental damages for loss, damage or delay, including weather delays.

SMOKING/ALCOHOL CONSUMPTION IS PROHIBITED ON THE COACH:
BayRunner Shuttle prohibits smoking of any kind, the use of tobacco products, drugs, alcohol on the bus. This includes the use of electronic simulated smoking materials, e cigarettes, vapes, marijuana, and smokeless cigarettes. Passengers are not permitted to bring alcoholic beverages or drugs of any nature on board the bus.

REFUSAL TO TRANSPORT:
BayRunner Shuttle shall have the right refuse to transport a passenger or shall have the right to remove a passenger from the vehicle at any point due to reasons of health and security, conduct that is disorderly, offensive, abusive, illegal, and violent or interferes with the duties of the driver or other passengers.

Disease Transmission: Waiver of Liability Relating to Coronavirus/COVID-19 and other disease transmission.
COVID-19, is extremely contagious disease. The virus and all known variants is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment or cure for COVID-19.

/bayRunners, Inc. (“BayRunner Shuttle”) cannot prevent its passengers from becoming exposed to, contracting, or spreading COVID-19 while utilizing BayRunner Shuttle’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize BayRunner Shuttle’s services and travel with BayRunner Shuttle by boarding BayRunner Shuttle’s buses, coaches or entering its terminals, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19 or other disease of unknown nature. BayRunner Shuttle has taken significant steps to comply with all safety precautions and exceed the known protocols of safety, including sanitizing and disinfecting all buses and developing contact free ticketing and boarding procedures.

ASSUMPTION OF RISK:
I have read and understand the above warning concerning COVID-19 and other infectious diseases. I hereby choose to accept the risk of contracting COVID-19 or any other infectious disease for myself and/or my children and pets in order to utilize BayRunner Shuttle’s services, travel on PPBL buses, coaches and enter its terminals. These services are of such value to me and/or to my children and pets that I accept the risk of being exposed to contracting and/or spreading COVID-19 or other infectious disease in order to utilize BayRunner Shuttle’s services.

WAIVER OF LAWSUIT/LIABILITY:
I hereby forever release and waive my right to bring suit against BayRunner Shuttle and its owners, officers, directors, managers, officials, trustees, agents, employees, or utilizing BayRunner Shuttle’s services, buses, coaches and terminal premises. I understand that this waiver means I give up my right to bring any claims against BayRunner Shuttle including for illness, discomfort, personal injuries, death, disease, lost wages, property losses, lost or stolen property or any other loss, including but not limited to claims of negligence and I give up any claim I may have to seek damages against BayRunner Shuttle, whether know or unknown, foreseen or unforeseen. By purchasing a ticket and using the services of BayRunner Shuttle, I agree to be bound by the provisions of these Terms and Conditions. BayRunner Shuttle cannot prevent hackers from accessing data without authority. In the event that the BayRunner Shuttle Site is hacked, BayRunner Shuttle will provide notification to its users in a timely manner so that all users are alerted to the risk of disclosure of private information.

By using this Site, you signify that you have read these Terms and Conditions of Use and that you assent to these terms and conditions of use. If you do not agree to follow each of the terms and conditions of use, do not use this Site.

BayRunners, Inc. (BayRunner Shuttle) reserves the right to update these terms and conditions at any time. Your continued use of the BayRunner Shuttle website (www.bayrunnershuttle.com) (the “Site”) means that you accept those changes.

The Site is protected by copyright under the United States and foreign laws. Title to the Site remains with BayRunner Shuttle. Any use of the Site not expressly permitted by these terms and conditions is a breach of these terms of conditions and may violate copyright, trademark and other laws. The Site and its features are subject to change or terminate without notice in the editorial discretion of BayRunner Shuttle. If you violate any of these terms and conditions, your permission to use the Site automatically terminates.

The Site is being presented for your individual and business use. BayRunner Shuttle grants to you a non-exclusive non-transferable, non-sublicensable, limited right and license to access the Site, and to use the Site and its resources for travel accommodations.

No Reproduction of Materials. The materials on the Site are protected under state and federal copyright and trademark law. By accessing and using the Site, you do not obtain any ownership interest or rights to the material found on the Site, nor are you permitted to copy or create any derivative works of using any portion of the material. All rights to the content of the Site, or the right to access the content or material thereon, automatically terminates along with the permission or license granted by us hereunder. Liability of BayRunner Shuttle and its Licensors. The use of the BayRunner Shuttle Site is at your own risk.

When using the BayRunner Shuttle Site, information will be transmitted over a medium which is beyond the control and jurisdiction of BayRunner Shuttle. Accordingly, BayRunner Shuttle assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the BayRunner Shuttle Site.

The BayRunner Shuttle Site is provided on an “as is” basis. BayRunner Shuttle and its licensors, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights and fitness for a particular purpose. Specifically, BayRunner Shuttle makes no representations or warranties as to the accuracy, reliability, completeness, currentness or timeliness of the materials, text, graphics, links, or communications provided on or through the use of the Site.
In no event, shall BayRunner Shuttle, its licensors or any third parties mentioned on the BayRunner Shuttle Site be liable for any damages, including without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from the use or inability to use the Site, whether based on warranty, contract, tort or any other legal theory, and whether or not BayRunner Shuttle is advised of the possibility of such damages. BayRunner Shuttle is not liable for any personal injury, including death, caused by the use or misuse of the Site or the services provided.

No Unlawful or Prohibited Use/Intellectual Property. You are granted a non- exclusive, non-transferrable, revocable license to access and use the Site strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to BayRunner Shuttle that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as a part of the Site, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of BayRunner Shuttle and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. General Restrictions. You may not transfer, copy or display the Site or its content, except as permitted herein. In addition, you may not sell, rent, lease, distribute, broadcast, sublicense or otherwise assign any right to the Site or its content to any third party. You may not attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management system used as part of the Site for any commercial or illegal purpose.

User Submissions. You agree that you will not upload or transmit any communications or content of any type that infringes or violates any rights of any party. You agree that any such submission is non-confidential for all purposes. If you make such submission, you are warranting that the owner of such content has expressly granted BayRunner Shuttle a royalty-free, perpetual, irrevocable, world-wide non-exclusive right to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form or format now known or hereafter developed.

BayRunner Shuttle Electronic Communications. Visiting the Site, inputting information and sending emails to BayRunner Shuttle constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

BayRunner Shuttle reserves the right but is not obligated to do any or all of the following:
Investigate the allegation that a communication does not conform to the terms of this Agreement;
Remove communications which are abusive, illegal or disruptive and otherwise fails to conform with these terms and conditions;

Terminating user’s access to any of the Site entirely upon any breach of these Terms and Conditions;

Monitor, edit or disclose any communication on the Site;

Edit or delete any communication posted on the Site, in the sole discretion of BayRunner Shuttle. BayRunner Shuttle reserves the right to take any action it deems necessary to protect the personal safety of our employees or the public. BayRunner Shuttle has no liability or responsibility to users of the BayRunner Shuttle Site or any person or entity for performance or nonperformance of the aforementioned activities.

Advertising and Links to Other Sites. BayRunner Shuttle does not endorse the content of any third- party website. BayRunner Shuttle is not responsible for the content of links, third-party sites, sites framed within the BayRunner Shuttle Site or third-party advertisements and does not make any representations regarding their content or accuracy. BayRunner Shuttle currently uses Transcor Data Services which is independently certified annually for data security. Your use of third-party websites is at your own risk.

Indemnity. You agree to defend, indemnify and hold BayRunner Shuttle, its officers, directors, employees, agents, licensors and suppliers harmless from and against any claims, actions or demands, liabilities and settlements, including without limitation reasonable legal and accounting fees resulting from or alleged to result from your use of the Site.

These Terms and Conditions are governed by the laws of the State of Maryland, without respect to its conflicts of law principles. If any provisions of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

BayRunner Shuttle is committed to serving people with disabilities in accordance with its obligations under the ADA. Individuals should contact BayRunner Shuttle with questions, concerns, or complaints regarding travel for customers with disabilities. Our contact information is listed below.

PURCHASE and TRAVEL ASSISTANCE:

If you have disability, we’ll do everything we can to help you have a comfortable journey when you ride with BayRunner Shuttle. While some disabilities and needs may be obvious to our employees, others are not, and you may be served by several different representatives of BayRunner Shuttle along the way. It is essential that you ask for assistance at each location where you need help, including each driver if you have different drivers for multiple legs of your trip.

Complete Agreement. These Terms and Conditions constitute the entire agreement between you and BayRunner Shuttle with respect to the use of the BayRunner Shuttle Site, except for updates and specific policy changes that may be published by BayRunner Shuttle from time to time. Your use of the BayRunner Shuttle Site is also subject to the BayRunner Shuttle disclaimers and policies posted herewith.

PRIVACY POLICY SCOPE:

This policy is designed to inform you of the BayRunners, Inc. (BayRunner Shuttle) policy regarding the collection, use and disclosure of information we receive from users of the Site. By using the Site, you agree to the collection and use of information in accordance with this policy. BayRunner Shuttle may disclose information received from users where BayRunner Shuttle reasonably believes that disclosure of such information is necessary to comply with law (including court and government orders, and civil subpoenas) or to BayRunner Shuttle’s agents and advisors so that they may provide their services to BayRunner Shuttle, and only under strict confidentiality restrictions.

Personal Information:
When using the Site, you may provide us with certain personally identifiable information that can be used to provide travel services to you. Personal identifiable information may include, but is not limited to your name, address, telephone number, email address, or any other information deemed necessary to provide the services.

Audio/Video Content:
Any audio or video content on the Site is for marketing and promotional purposes only and may not be duplicated by visitors.

SECURITY:

We take precautions to protect your information. When you submit sensitive information via the Site, your information is protected both online and offline. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser or looking for “https” at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment. BayRunner Shuttle currently uses, Transcor Data Services which is independently certified annually for data security.

BayRunner Shuttle recognizes the importance of protecting our users’ privacy. To that end we have created this privacy statement in order to demonstrate our commitment to privacy. Information on how Site content can and cannot be used is also listed below. Please note that laws and regulations above and beyond BayRunner Shuttle ‘s policies may apply to commercial electronic messages sent to individuals who have elected to list their contact information on the BayRunner Shuttle website. BayRunner Shuttle strives to comply with all privacy laws.

WHAT INFORMATION IS COLLECTED:

BayRunner Shuttle and its Web hosting company, acting as BayRunner Shuttle’s agent, collect and store technical information about your visit to our website. We use this information for statistical purposes to make our Site more accessible to visitors and the information we collect is not provided to any other third party.
